EXCEPT AS EXPRESSLY REQUIRED BY LAW WITHOUT THE POSSIBILITY OF CONTRACTUAL WAIVER, END 2 END SYSTEMS, LLC (THE “COMPANY”) DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE OR TRADE PRACTICE. THE CUSTOMER IS SOLELY RESPONSIBLE FOR THE SUITABILITY OF ALL GOODS AND SERVICES CHOSEN AND FOR DETERMINING WHETHER THEY MEET THE CUSTOMER’S CAPACITY AND PERFORMANCE NEEDS. COMPANY DOES NOT WARRANT THAT THE INTERNET SERVICE WILL FUNCTION AS DESCRIBED, WILL BE UNINTERRUPTED OR ERROR-FREE, FREE OF HARMFUL COMPONENTS, OR THAT THE DATA CUSTOMER STORES WITHIN THE INTERNET SERVICE WILL BE SECURE OR NOT OTHERWISE LOST OR DAMAGED. COMPANY SHALL NOT BE RESPONSIBLE FOR ANY SERVICE INTERRUPTIONS, INCLUDING, WITHOUT LIMITATION, POWER OUTAGES, SYSTEM FAILURES OR OTHER INTERRUPTIONS. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE INTERNET SERVICES REMAINS WITH THE CUSTOMER.
 
THE COMPANY DOES NOT WARRANT THAT THE INTERNET SERVICE WILL BE COMPLETELY SECURE, CONTINUOUS, ERROR-FREE, OR THAT ALL DEFECTS WILL BE CORRECTED. THE CUSTOMER ACKNOWLEDGES THAT THE COMPANY DOES NOT CONTROL OR MONITOR THE INTERNET, AND THAT THE INTERNET CARRIES WITH IT THE RISK THAT THE CUSTOMER’S PROPERTY, PRIVACY, AND CONFIDENTIAL INFORMATION MAY BE LOST OR COMPROMISED. THIS AGREEMNT INCORPORATES THE TERMS OF THE SERVICE AGREEMENT
